Indemnity Policy

1. Assumption of Risk

Travel, by its nature, involves certain inherent risks. By participating in any Noli Travels trip or event, you voluntarily acknowledge and accept that there may be risks involved, including but not limited to:

• Physical injury or illness during travel or activities
• Loss or damage to personal property
• Delays, changes, or cancellations due to weather, political unrest, or other unforeseen events
• Risks associated with adventure or outdoor activities
• Risks inherent in international travel

2. Limitation of Liability

To the fullest extent permitted by South African law, Noli Travels, its directors, employees, agents, and representatives shall not be liable for:

• Any personal injury, illness, death, or property loss or damage sustained during a trip or event
• Any loss arising from the negligence of third-party service providers (e.g., hotels, airlines, transport operators)
• Any indirect, special, or consequential loss or damage
• Losses arising from force majeure events, including natural disasters, pandemics, or civil unrest

3. Indemnification

By participating in a Noli Travels experience, you agree to indemnify, defend, and hold harmless Noli Travels and its representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to your participation, your breach of these policies, or your violation of any applicable law.

4. Health & Fitness

You confirm that you are in good health and physically capable of participating in the booked trip or activity. You accept full responsibility for any health-related issues that arise during the trip. Noli Travels strongly recommends consulting a medical professional before travelling, particularly for international trips.

5. Third-Party Services

Noli Travels acts as an organiser and coordinator, and may use third-party providers for accommodation, transport, activities, and other services. Noli Travels is not responsible for the acts or omissions of such third parties and shall not be liable for any loss or damage caused by their services.

6. Governing Law

This Indemnity Policy shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from this policy shall be subject to the jurisdiction of the South African courts.
